1. Legal Notice and Acceptance

This legal notice regulates the use of the website www.citrosol.com (the “Portal”) which is owned by PRODUCTOS CITROSOL, S.A. (hereinafter, “CITROSOL” or THE OWNER OF THE WEBSITE).

THE OWNER OF THE WEBSITE makes this document available to USERs under the provisions of the European Parliament and Council Regulation 2016/679 of 27 April 2016, regarding the protection of individual persons in respect of the processing of personal data and the free circulation of such data (hereinafter, the “GDPR”) and the Spanish law pertaining to the Protection of Personal Data and Digital Rights Guarantees (Ley Orgánica 3/2018, de diciembre 5, de Protección de Datos Personales y Garantía de Derechos Digitales (LOPDGDD)), in order to inform all USERs of the website of the conditions of use thereof.

4. INTELLECTUAL AND INDUSTRIAL PROPERTY

All the contents of the Portal, understood by these as merely illustrative, the Web page itself, screens, texts, data and information of any kind, the structure, photographs, graphics, images, icons, technology, software, links and other Audiovisual or sound content, as well as its graphic design and source codes (hereinafter, the “Contents“), are the intellectual property of CITROSOL or third parties, without any of the exploitation rights recognized by current regulations being understood to be assigned to the User in matters of intellectual property over them, except those that are strictly necessary for the use of the Portal.

The trademarks, logos, trade names or distinctive signs are the property of CITROSOL or third parties, without it being understood that access to the Portal attributes any right over the aforementioned trademarks, logos, trade names and/or distinctive signs.

In short, the users who access this website can view the contents and, where appropriate, make authorized private copies provided that the reproduced elements are not subsequently transferred to third parties, nor are they installed on network connected servers, nor are they subject to any form of exploitation.

5.1 GENERAL

2. Reproduce or copy the Contents for private use that may be considered as Software or Database in accordance with current legislation on intellectual property, nor publish nor make available to third parties when these acts necessarily imply reproduction by the User or a third party.

3. Extract and/or reuse all or a substantial part of the Contents of the Portal including the applications and/or databases, where appropriate, that CITROSOL may make available to Users.

5.3. DATA COLLECTION FORMS

Without prejudice to the provisions of this Legal Notice, as well as the privacy policies accessible from the Portal and that may be applicable at any time, the use of certain services or requests addressed to CITROSOL are conditioned on the prior completion of the corresponding registration of the User and/or Client Conditions .

All the information provided by the User through the Portal forms for the above purposes or any other must be truthful. To that effect, the User guarantees the authenticity of all the data that he/she provides and will keep the information provided to CITROSOL correctly updated so that it responds, at all times, to the real situation of the User. In all cases, the User will be solely responsible for any false or inaccurate statement made and the damages caused to CITROSOL or third parties by the information provided.

5.4. INTRODUCTION OF HYPERLINKS TO THE PORTAL

The Internet User who wants to insert links from their own web pages to the Portal must comply with the conditions detailed below and ignorance of the same will not avoid the responsibilities derived from Law:

1. The link will only link to the home page or main page of the Portal but it may not be reproduced in any way (inline links, copy of texts, graphics, etc.).

2. It is prohibited, in accordance with the applicable legislation in force at any time, in all cases, to establish frames of any type that surround the Portal or allow the viewing of the Contents through Internet addresses other than those of the Portal and, in any case, when they are viewed together with content outside the Portal in such a way that: (I) produces, or may produce, error, confusion or deception of the users about the true origin of the service or Contents; (II) involves an act of comparison or unfair imitation; (III) serves to take advantage of CITROSOL’s brand reputation and prestige or (IV) in any other way is prohibited by current legislation.

3. No false, inaccurate or incorrect statement about CITROSOL, its partners, employees, clients or the quality of the services it provides will be made from the page that introduces the link.

4. In no case will it be stated on the page where the link is located that CITROSOL has given its consent for the link to be inserted or that it otherwise sponsors, collaborates, verifies or oversees the sender’s services.

5.5. QUALITY OF SERVICE

Access to the Portal does not imply any obligation on the part of CITROSOL to control the absence of viruses, worms or any other harmful computer element. In all cases, the User is responsible for the availability of adequate tools for the detection and disinfection of harmful computer programs.

CITROSOL is not responsible for the damages produced in the computer equipment of the Users or third parties during the provision of the Portal service.

5.6. AVAILABILITY OF THE SERVICE

Access to the Portal requires services and supplies from third parties, including transportation through telecommunications networks whose reliability, quality, continuity and operation do not correspond to CITROSOL. Consequently, the services provided through the Portal may be suspended, canceled or become inaccessible, prior to or during the provision of the Portal service.

CITROSOL is not responsible for damages or losses of any kind suffered by the User that are caused by failures or disconnections in the telecommunications networks that cause the suspension, cancellation or interruption of the Portal service during the provision of the same or beforehand.

5.7. CONTENTS AND SERVICES LINKED THROUGH THE PORTAL

The Portal access service includes technical linking devices, directories and even search instruments that allow the User to access other Internet pages and portals (hereinafter ‘Linked Sites’). In these cases, CITROSOL acts as a provider of intermediation services in accordance with article 17 of Law 34/2002, of July 12, on Services of the Information Society and Electronic Commerce (‘LSSI’) and will only be responsible for the content and services provided on the Linked Sites to the extent that CITROSOL has effective knowledge of the illegality and has not deactivated the link with due diligence. In the event that the User considers that there is a Linked Site with illicit or inappropriate content, he/she may communicate it to CITROSOL, without, under any circumstance said communication generating an obligation to remove the corresponding link.

Under no circumstances should the existence of Linked Sites presuppose the existence of agreements with the managers or owners thereof, nor the recommendation, promotion or identification of CITROSOL with the statements, content or services provided thereon.

CITROSOL does not know the contents or services of the Linked Sites and therefore cannot be held responsible for damages caused by the illegality, quality, outdatedness, unavailability, error and uselessness of the contents and/or services of the Linked Sites or for other damage that is not directly attributable to CITROSOL.

6. COMMUNICATION OF ACTIVITIES OF ILLICIT OR INAPPROPRIATE NATURE

In the event that the User or any other Internet user is aware that the Linked Sites refer to pages whose content or services are illegal, harmful, demeaning, violent or immoral, they may contact CITROSOL indicating the following points :

1. Personal information of the caller: name, address, telephone number and email address;

2. Description of the facts that reveal the illegal or inappropriate nature of the Linked Site;

3. In the event of violation of rights, such as intellectual and industrial property, the personal data of the owner of the infringed right when he is a person other than the communicator. Likewise, it must provide the title that proves the legitimacy of the owner of the rights and, where appropriate, that of representation to act on behalf of the owner when he/she is a person other than the communicator;

4. Express declaration that the information contained in the claim is accurate.

The reception by CITROSOL of the communication provided in this clause will not imply, according to the provisions of the LSSI, the effective knowledge of the activities and/or contents indicated by the communicator.

Likewise, it must provide the title that proves the legitimacy of the owner of the rights and, where appropriate, that of representation to act on behalf of the owner when he/she is a person other than the communicator.
